Is Lindsay Lohan Finally Going To Jail?

Yes she has done it again – Lindsay Lohan has violated her probation.

The star however arrived on time for yet another court appearance in Los Angeles today.

The Mean Girls star, 24, is accused of testing positive for alcohol while under house arrest last week.

Lohan was seen wearing dark sunglasses, a blue and white striped shirt and black trousers. She had a classic Chanel handbag slung over her shoulder.

In 2007, the judge in Lindsay’s DUI case, Elden Fox, instructed her to stay sober under the terms of her probation and warned her she would find herself behind bars if she did not comply.

Well it looks like Lohan may be guilty of violating her probation.

According to U.S. reports, Lohan took two sobriety tests last week – one which she passed and one which she failed. In both tests she is understood to have tested negative for drugs.

The one test was apparently conducted shortly after Lohan, who is currently under house arrest, threw a rooftop barbecue party at her home in Venice, California.

The LA County Probation Department will reportedly ask Judge Sautner to cancel the actress’s house arrest and sentence her to jail.

Representatives from the District Attorney’s office will also apparently be present to attempt to strengthen the case against Lohan.

Seems like everyone wants to see the star behind bars.

Lohan began a 35-day house arrest term last month after being accused of stealing a $2,500 necklace from a jewelry store in Venice.

Lindsay was originally sentenced to 120 days behind bars after pleading no contest to a misdemeanor charge but her punishment was reduced to 35 days of home confinement due to jail overcrowding. She was expected to be released on June 29 and would have been free to celebrate her 25th birthday on July 2.

Today, Lindsay’s father said that his troubled daughter needs to go to rehab and not to be sent to jail.

‘I’m so worried about my daughter,’ he told RadarOnline. ‘I’m very concerned about the people around Lindsay and the pressure being put upon her.’

‘If it turns out that the test was positive, then I have strong concerns because if a person can’t stay straight in the house where can she stay straight?’ Michael added.

The father-of-four said that he last saw Lindsay on Father’s Day last Sunday and she seemed fine.

‘When I saw her over the weekend to me she didn’t seem like she had any alcohol in her system,’ he said.

‘I’m still opposed to jail. She needs to go into rehab. She needs to be in a program called G&G Holistic in Florida.

‘I don’t think Lindsay needs to be on any prescription drugs, and I think that’s part of the problem,’ he expressed.

He also hit back at critics who say Lindsay should not have shot a commercial while under house arrest saying ‘what’s wrong with that?’

Meanwhile the Deputy District Attorney who has prosecuted Lindsay’s in prior incidents has criticized the actress for her behaviour while under house arrest.

Danette Meyers spoke to RadarOnline on Tuesday night where she voiced her concerns about Lindsay partying on her rooftop and shooting a commercial while in home confinement.

‘I think that Ms. Lohan should really be trying to get rehabilitated,’ Meyers said.

‘I think that she really needs to be at home and read, and do some types of things that go towards her rehabilitation, and it’s unfortunate that she is not doing those things if she is shooting a commercial.

‘She really needs to take some time out and think about the things that she has done and think about the things she can do to be productive.’

Meyers also suggested that Lindsay do some public service announcements about the perils of drinking and driving.

‘It’s unfortunate to me that she is not doing that, I was hoping that she would, once she got that big huge break from Judge Sautner,’ Meyers stated.

‘I don’t think she is taking her issues seriously enough. I really do believe that she should be on television doing PSAs about the evils of alcohol and driving,’ Meyers added.

‘I really think she ought to be home, dealing with her problems, reading up on the literature about substance abuse problems if she has them and she is not doing that if she is shooting commercials.’

Just yesterday Lindsay shot a comedy sketch inside her home to help promote Air New Zealand.

According to TMZ, she signed on with the airline to film a webisode with puppets, similar to the project that rapper Snoop did for the company back in March.

Lindsay tested positive for alcohol during a urine test taken on either on June 12 or 13.

She had claimed that she did not allow any alcohol in her home but TMZ have published a photo of an open bottle of wine taken on June 9, which is three days before her rooftop barbecue.

Maybe Lindsay knew this was coming because she cancelled an interview with The Today Show’s Matt Lauer who had flown in from New York for an exclusive sit down with the star.

TMZ reported that Lindsay was in the make-up chair ready to go but at the eleventh hour changed her mind after finding out the interview would be more in-depth than initially discussed.

The actress had also just given an interview with Life & Style magazine about wanting to prove her critics wrong and getting back to work while keeping up a healthy lifestyle.

She opened up about what her typical days have been like since she started her sentence on May 26.

‘I’ve been having a lot of work-related meetings. Sometimes my friends come over. I get to see my sister, Ali, which is nice.’

The actress also shared what she felt is the biggest misconception about her saying that people do not believe she takes things seriously, an ironic statement considering today’s developments.

‘I do take responsibility for my actions. I’m not going to being any drama into my life anymore or put myself in any situations that might cause drama. I’ve grown up – and I’m willing to do what I have to do to prove that.

According to Lohan, the positive side about her house arrest is that it is keeping her out of the public eye and she is able to now focus on what she wants to do next.

The 3,000 square feet triplex is worth $2.25million but she is reportedly renting the place for $7,000 a month.

The home boasts three bedrooms and four bathrooms and is nestled right by the beach.

And now for the answer you have all been waiting for ….

Lindsay Lohan will not be doing any jail time this time.

“If there is an ambiguity it gets resolved in favor of the defendant,” Judge Sautner said once the parties returned to open court. “If you are guilty of a violation of probation, I don’t see it. But what you are guilty of is extremely poor judgment. Having parties on the roof.”

Lucky for Lindsay, Sautner noted, “Poor judgment is not a violation of your probation.”

Sautner underscored her scolding by adding that Lohan’s neighbors have been writing letters to the court complaining about her behavior.

“You are not allowed to have parties,” Judge Stephanie Sautner said. “House arrest is akin to being in jail. You can have one friend over and that is it.”

“Right now there is no drug or testing in effect,” Sautner continued, denying the District Attorney’s request to modify her probation to include drug and alcohol testing.

“Do you want to go on with your life?” the judge, who delivered a serious scolding in open court, said.

“Yes, I do,” Lohan responded.

Still, the question remains – if Lindsay was not in violation of her probation, what gives with the positive alcohol test?

Go figure.
